Obama Guts Welfare Reform ? The Foundry

Today, the Obama Department of Health and Human Services (HHS) released an official policy directive rewriting the welfare reform law of 1996. The new policy guts the federal work requirements that were the foundation of the reform law. The Obama directive bludgeons the letter and intent of the actual reform legislation.

Welfare Reform under Clinton

Welfare reform replaced the old Aid to Families with Dependent Children with a new program, Temporary Assistance for Needy Families (TANF). The underlying concept of welfare reform was that able-bodied adults should be required to work or prepare for work as a condition of receiving welfare aid.

The welfare reform law is often characterized as simply giving state governments more flexibility in operating welfare programs. This is a serious misunderstanding. While new law (the Personal Responsibility and Work Opportunity Reconciliation Act of 1996) did grants states more flexibility in some respects, the core of the act was the creation of rigorous new federal work standards that state governments were required to implement.

The welfare reform law was very successful. In the four decades prior to welfare reform, the welfare caseload never experienced a significant decline. But, in the four years after welfare reform, the caseload dropped by nearly half. Employment surged and child poverty among affected groups plummeted. The driving force behind these improvements was the rigorous new federal work requirements contained in the TANF law.

Obama?s Trick to Get Around Work Requirements

Today the Obama Administration issued a new directive stating that the traditional TANF work requirements can be waived or overridden by a legal device called the section 1115 waiver authority under the Social Security law (42 U.S.C. 1315).

Section 1115 states that ?the Secretary may waive compliance with any of the requirements? of specified parts of various laws. But this is not an open-ended authority: Any provision of law that can be waived under section 1115 must be listed in section 1115 itself. The work provisions of the TANF program are contained in section 407 (entitled, appropriately, ?mandatory work requirements?). Critically, this section, as well as most other TANF requirements, are deliberately not listed in section 1115; they are not waiveable.

In establishing TANF, Congress deliberately exempted or shielded nearly all of the TANF program from the section 1115 waiver authority. They did not want the law to be rewritten at the whim of Health and Human Services (HHS) bureaucrats. Of the roughly 35 sections of the TANF law, only one is listed as waiveable under section 1115. This is section 402.

Section 402 describes state plans ? reports that state governments must file to HHS describing the actions they will undertake to comply with the many requirements established in the other sections of the TANF law. The authority to waive section 402 provides the option to waive state reporting requirements only, not to overturn the core requirements of the TANF program contained in the other sections of the TANF law.

The new Obama dictate asserts that because the work requirements, established in section 407, are mentioned as an item that state governments must report about in section 402, all the work requirements can be waived. This removes the core of the TANF program; TANF becomes a blank slate that HHS bureaucrats and liberal state bureaucrats can rewrite at will.

Congressional Research Service: ?There Are No TANF Waivers?

In a December 2001 document, ?Welfare Reform Waivers and TANF,? the non-partisan Congressional Research Service clarified that the limited authority to waive state reporting requirement in section 402 does not grant authority to override work and other major requirements in the other sections of the TANF law (sections that were deliberately not listed under the section 1115 waiver authority):

Technically, there is waiver authority for TANF state plan requirement; however, [the] major TANF requirements are not in state plans. Effectively, there are no TANF waivers.

Obviously, if the Congress had wanted HHS to be able to waive the TANF work requirements laid out in section 407, it would have listed that section as waiveable under section 1115. It did not do that.

Define ?Work??

In the past, state bureaucrats have attempted to define activities such as hula dancing, attending Weight Watchers, and bed rest as ?work.? These dodges were blocked by the federal work standards. Now that the Obama Administration has abolished those standards, we can expect ?work? in the TANF program to mean anything but work.

The new welfare dictate issued by the Obama Administration clearly guts the law. The Administration tramples on the actual legislation passed by Congress and seeks to impose its own policy choices ? a pattern that has become all too common in this Administration.

The result is the end of welfare reform.

Today?s historically low mortgage interest rates are good news for both prospective and current homeowners. Families that want to buy can afford more home for their money. And homeowners may be able to refinance their mortgages and lower their monthly payments, or tap into their home?s equity to pay for expenses such as school tuition for their children or a major renovation.

But, the 30-year fixed rate mortgage ? the primary housing financing tool for most Americans ? is being threatened. ?Some members of Congress are pushing to end the federal backstop for housing. Without a federal role to absorb market risk, private lenders would increase interest rates and fees on all types of available financing options, including the 30-year, fixed-rate mortgage.

Economists agree that there can be no sustainable economic recovery until the housing market rebounds. A sound housing finance system that provides a stable and affordable supply of credit for home buyers and rental housing is essential to ensure a healthy housing market, to keep standard 30-year fixed-rate loans and adjustable rate mortgages readily accessible and affordable, to spur job creation and to maintain a strong and durable economy.

During the Great Depression, the national homeownership rate was well under 50 percent and buyers were often forced to finance their homes with a 50 percent downpayment on a five-year balloon mortgage. The 30-year, fixed-rate mortgage came about as a result of President Franklin Roosevelt?s New Deal policies and played a pivotal role in helping to increase the national homeownership rate so that today two out of three Americans own a home.

The 30-year loan is the most popular and sustainable mortgage in the marketplace for many reasons, including:

? Affordability. Thirty-year terms lock in low monthly payments, allowing households with average incomes to comfortably budget for their home loan.

? Inflation protection. Knowing their monthly housing costs will remain the same year in and year out regardless of whether interest rates rise provides households with a sense of financial security and also acts as a hedge against inflation.

? Long-term planning. Many young buyers know that as their incomes rise, their mortgage payment will stay constant and take up less of their monthly budget, which will enable them to save for other costs like their children?s school tuitions and retirement.

? Tax advantages. In most instances, all of the interest and property taxes a home owner pays in a given year can be deducted from their gross income, reducing their taxable income. This can result in thousands of dollars of tax savings, especially in the early years of a 30-year mortgage when interest makes up most of the payment.

Sprint Epic 4G Touch and US Cellular Galaxy S II ICS updates are official, start rolling out today

Just as the leak last night indicated, Samsung is finally ready to deliver Ice Cream Sandwich to Sprint's Galaxy S II Epic 4G Touch. Samsung also announced today that US Cellular's similar but WiMAX-less SCH-R760 Galaxy S II is getting the same FF18 update as well. The changelogs are available at the source links below, interestingly Android Beam is mentioned since these devices lack NFC, it's hard to see how that could be on the list. US Cellular users can download and install the update right now using a SimpleDL tool on a Windows PC, however unfortunately there's no support for any other operating systems at this time. On Sprint the update is coming out OTA and will slowly arrive on devices over the next few days, but if you're impatient then we'd keep an eye on the thread at XDA Developers for reports on how well it works as well as some sideloaded workarounds.

Catholic Melinda Gates defies the Vatican over birth control funds

At an extraordinary summit in London, Mrs Gates announced that the charitable foundation she set up with her Microsoft founder husband Bill was donating $560m to family planning services.

The size of the donation is intended to emphasise the Bill and Melinda Gates Foundation?s commitment to reducing unwanted pregnancies in poorer countries, which experts say lead to more than 100,000 women dying prematurely every year.

A life-long Catholic, Mrs Gates said she had grappled with her faith before deciding to speak out against the Vatican?s opposition to contraception.?

?Of course I wrestled with this. As a Catholic I believe in this religion, there are amazing things about this religion, amazing moral teachings that I do believe in, but I also have to think about how we keep women alive,? she said in an interview in advance of the summit.

?I believe in not letting women die, I believe in not letting babies die, and to me that?s more important than arguing about what method of contraception [is right].?

The summit, co-hosted by the Gates Foundation and Department for International Development, started with a remarkable declaration by the Indian government pledged to provide free access to family planning for all 64 million women currently denied the opportunity to control when and how many children to have.

Cash pledges then came in thick and fast from world leaders, with more than ?3bn by the end of the day, Almost half of contribution were from developing countries.

David Cameron was given a standing ovation after announcing Britain is doubling its financial support for family planning services to ?1bn over the next eight years, but was immediately asked how he would tackle religious opposition to the efforts.

He said Britain?s contribution would save the life of a woman or girl in the developing world every two hours for the next eight years by preventing deaths caused by too many pregnancies, too close together.?

Mr Cameron and Andrew Mitchell, international development minister, were widely praised for showing leadership and commitment to women?s health, though the funding is not new money and will come out of existing aid budgets.

Australia and Germany both agreed to double their contributions for family planning programmes. Nigeria, where only one in 10 couples currently use contraception, announced a 300 per cent increase in funds.

In total, the summit raised nearly enough money to expand family planning programmes to an extra 120 million women.

In her speech Mrs Gates said: ?What we?re doing is an enormous undertaking? We?re committed to innovating constantly; we?re committed to educating women about their options? It is a difficult task but it is absolutely urgent.?

Mr Cameron said: ?When a woman is prevented from choosing when to have children it is not just a violation of her human rights it can fundamentally compromise her chances in life and the opportunities for her children.

?Family planning works not just because smaller families can be healthier and wealthier but because empowering women is the key to growing economies and healthy open societies.?

Mr Cameron added: ?We?re not talking about some kind of Western imposed population control, forced abortion or sterilisation.

?What we?re saying today is quite the opposite. We?re not telling anyone what to do. We?re giving women and girls the power to decide for themselves.?

An estimated 220 million women around the world do not have access to contraceptives or family planning information.

In some countries women need written consent from their husbands before they can talk to a doctor about contraception while in others, family planning services are not offered to adolescents or unmarried women. In others, contraceptives are frequently out of stock when women need them.

For the past two decades vaccinations against infectious diseases have been pursued as the global health priority at the expense of contraception and family planning. But a series of papers published in The Lancet earlier this week concluded that addressing the unmet need for contraception was crucial if Millennium Development Goals on maternal deaths, poverty and gender equality were to be ever achieved.

And a recent report from Save the Children said every year one million teenage girls die or is injured because of pregnancy or childbirth ? making pregnancy is the biggest killer of teenage girls worldwide.

Mrs Gates said the Foundation had initially focussed on vaccines because women would not choose to have fewer children until they were sure their children would survive childhood

In address by video link, Aung Sang Suu Kyi told delegates that giving women control over family planning would lead to healthier, better educated women and children for the future.

Bill and Melinda: A labour of love

The Bill and Melinda Gates Foundation was set-up by the Microsoft founder and his wife in 1994. Since then it has become a significant player in global development and health. As co-chairs of the Foundation, the Gates? are intimately involved in its work.

Latest figures show that the foundation has funded $26.2bn worth of programmes and grants, including more than $6bn for libraries, scholarships, emergency relief, schools and homelessness in the United States.

Global health is their first love, on which more than $15bn has been spent so far. They are probably best known for their work on Malaria, vaccines and HIV/Aids, but have also invested significantly in research and treatments for diarrheal diseases, TB and pneumonia which costs millions of lives every year. They have offices in India and China where large programmes of work are focused.

COLUMBUS, Ohio - A new study reveals a simple strategy that people can use to minimize how angry and aggressive they get when they are provoked by others.

When someone makes you angry, try to pretend you're viewing the scene at a distance - in other words, you are an observer rather than a participant in this stressful situation. Then, from that distanced perspective, try to understand your feelings.

Researchers call this strategy "self-distancing."

In one study, college students who believed a lab partner was berating them for not following directions responded less aggressively and showed less anger when they were told to take analyze their feelings from a self-distanced perspective.

"The secret is to not get immersed in your own anger and, instead, have a more detached view," said Dominik Mischkowski, lead author of the research and a graduate student in psychology at Ohio State University.

"You have to see yourself in this stressful situation as a fly on the wall would see it."

While other studies have examined the value of self-distancing for calming angry feelings, this is the first to show that it can work in the heat of the moment, when people are most likely to act aggressively, Mischkowski said.

The worst thing to do in an anger-inducing situation is what people normally do: try to focus on their hurt and angry feelings to understand them, said Brad Bushman, a co-author of the study and professor of communication and psychology at Ohio State.

"If you focus too much on how you're feeling, it usually backfires," Bushman said.

"It keeps the aggressive thoughts and feelings active in your mind, which makes it more likely that you'll act aggressively."

Mischkowski and Bushman conducted the study with Ethan Kross of the University of Michigan. Their findings appear online in the Journal of Experimental Social Psychology and will be published in a future print edition.

There were two related studies. The first involved 94 college students who were told they were participating in a study about the effects of music on problem solving, creativity and emotions.

The students listened to an intense piece of classical music while attempting to solve 14 difficult anagrams (rearranging a group of letters to form a word such as "pandemonium"). They had only seven seconds to solve each anagram, record their answer and communicate it to the experimenter over an intercom.

But the plan of the study was to provoke the students into anger, which the experimenters did using a technique which has been used many times in similar studies.

The experimenter interrupted the study participants several times to ask them to speak louder into the intercom, finally saying "Look, this is the third time I have to say this! Can't you follow directions? Speak louder!"

After this part of the experiment, the participants were told they would be participating in a task examining the effects of music on creativity and feelings.

The students were told to go back to the anagram task and "see the scene in your mind's eye." They were put into three groups, each of which were asked to view the scene in different ways.

Some students were told to adopt a self-immersed perspective ("see the situation unfold through your eyes as if it were happening to you all over again") and then analyze their feelings surrounding the event. Others were told to use the self-distancing perspective ("move away from the situation to a point where you can now watch the event unfold from a distancewatch the situation unfold as if it were happening to the distant you all over again") and then analyze their feelings. The third control group was not told how to view the scene or analyze their feelings.

Each group was told the replay the scene in their minds for 45 seconds.

The researchers then tested the participants for aggressive thoughts and angry feelings.

Results showed that students who used the self-distancing perspective had fewer aggressive thoughts and felt less angry than both those who used the self-immersed approach and those in the control group.

"The self-distancing approach helped people regulate their angry feelings and also reduced their aggressive thoughts," Mischkowski said.

In a second study, the researchers went further and showed that self-distancing can actually make people less aggressive when they've been provoked.

In this study, 95 college students were told they were going to do an anagram task, similar to the one in the previous experiment. But in this case, they were told they were going to be working with an unseen student partner, rather than one of researchers (in reality, it actually was one of the researchers). In this case, the supposed partner was the one who delivered the scathing comments about following directions.

As in the first study, the participants were then randomly assigned to analyze their feelings surrounding the task from a self-immersed or a self-distanced perspective. Participants assigned to a third control group did not receive any instructions regarding how to view the scene or focus on their feelings.

Next, the participants were told they would be competing against the same partner who had provoked them earlier in a reaction-time task. The winner of the task would get the opportunity to blast the loser with noise through headphones - and the winner chose the intensity and length of the noise blast.

The findings showed that participants who used the self-distancing perspective to think about their partners' provocations showed lower levels of aggression than those in the other two groups. In other words, their noise blasts against their partner tended to be shorter and less intense.

"These participants were tested very shortly after they had been provoked by their partner," Mischkowski said.

"The fact that those who used self-distancing showed lower levels of aggression shows that this technique can work in the heat of the moment, when the anger is still fresh."

"Many people seem to believe that immersing themselves in their anger has a cathartic effect, but it doesn't. It backfires and makes people more aggressive," Bushman said.

Another technique people are sometimes told to use when angered is to distract themselves - think of something calming to take their mind off their anger.

Mischkowski said this may be effective in the short-term, but the anger will return when the distraction is not there.

"But self-distancing really works, even right after a provocation - it is a powerful intervention tool that anyone can use when they're angry."

Vets upset with court overturning lying law

Jack Jacobs can proudly ? and truthfully ? say he was awarded the Medal of Honor for his valor in Vietnam. After a recent Supreme Court ruling, anyone else is free under the First Amendment to make the same claim, whether it's true or not.

Some military veterans say they consider the ruling a slap in the face. For Jacobs, though, it was the right decision. He said he wore the uniform to protect people's rights ? even if he doesn't agree with how they exercise those rights.

"There are lots of things people do that revolt me, but I'm happy that I fought for this country not to give them the right to do something stupid, but for the majority of the people to do the right thing," said Jacobs, 66, who earned the Medal of Honor in 1969 for carrying several of his buddies to safety from a shelled rice field despite the shrapnel wounds in his head, the streaming blood clouding his vision.

"I'm a free speech guy," he said.

The high court ruled 6-3 on Thursday to toss out the conviction of Xavier Alvarez, a former California politician who lied about being a decorated military veteran. He had been charged under the 2006 Stolen Valor Act, which made it a crime to lie about receiving the Medal of Honor and other prestigious military recognitions. The decision invalidated the law, as the justices ruled Alvarez's fabricated story was constitutionally protected speech.

For 87-year-old Murel Winans, lies about service can cause real harm and lead people to doubt the veracity of claims made by people who actually served during wartime. He said he didn't buy the free speech argument.

"You feel like you never earned it, because when you tell someone what you've done, they'll say, 'you're lying just like those other guys,'" said Winans, 87, who described himself as a "fresh young hillbilly from West Virginia" when he landed on Normandy's Omaha Beach on June 6, 1944 ? his 19th birthday.

The law was inspired by the 1998 book "Stolen Valor" by B.G. "Jug" Burkett, a Vietnam veteran. The government had argued the law was a needed tool to protect the integrity of military medals.

The ruling was issued the same day as the high court's landmark decision upholding President Barack Obama's signature health care overhaul. While much of the nation watched with rapt focus on what would become of the law that requires every American to have health insurance, many people in military communities were more focused on the ruling on the Stolen Valor Act.

Supreme Court strikes down Stolen Valor Act

Emotions ran high in Fayetteville, home to the 251-square-mile Fort Bragg. About 38 percent of North Carolina's population is either currently in the service, a veteran or a dependent of one, according to the N.C. Department of Administration. The state is also home to the sprawling Camp Lejeune, known for its training in amphibious assaults like the one at Normandy.

"My boys are out there giving their heart and soul," said Rose Moore, whose son is stationed in Afghanistan. "To have someone say they did it and they didn't do anything ? it's a lie, it's dishonest."

Army Capt. Albert Bryant acknowledged that he was disappointed, saying the lies can detract from people who earn something like the Medal of Honor. However, his disappointment was somewhat tempered.

"I know it's the First Amendment, but maybe you need to have an amendment to the amendment to protect our enlisted men and women," Bryant said. "Very few things in life are black and white so you have to take certain things in context, but there has to be some kind of common sense applied."

The decision doesn't give anyone carte blanche to lie about their service record in an effort to get free perks, however. Anyone who fabricates any honors can still face fraud charges, which is what happened to former Marine Sgt. David Budwah in 2009. He was demoted to private and dishonorably discharged after pretending to be a wounded war hero to get free seats at rock concerts and sports events.

Twenty-year Army veteran Raymond Hunt said the justices made the right move in protecting free speech. He said it's enough that Alvarez has been publicly shamed.

"For the rest of his life he has to walk around with that look on his face and know that he was the biggest liar in the country on something that is so sensitive to our country," Hunt said.

Retired Army Lt. Hal Fritz said the court treated those medals as something abstract. But for him, it's a memory.

Fritz was leading a seven-vehicle armored column down a Vietnam highway in 1969 when enemy combatants launched a surprise attack from all sides. Fritz was seriously wounded in the crossfire, but ran through the machine gun blasts to rally his troops. After his platoon survived the first wave, Fritz charged into a second enemy advancement armed with only a pistol and a bayonet. He was seriously wounded, but refused medical attention until all of his men had been cared for. He was awarded the Medal of Honor in 1971.

"We would disagree with the majority saying lying about receiving the medals doesn't devalue them," said Fritz, 68, who now lives in Illinois. "I would say go back with me to Vietnam dragging the dead and dying off the battlefield."

The Medal of Honor is among the rarest of honors: Only 81 of the 3,457 recipients since the Civil War are still living. Of those, only three are younger than 35, according to the Congressional Medal of Honor Society.

Of those interviewed, the Medal of Honor recipients agreed that Congress should try again to pass a similar law that would survive judicial scrutiny. That didn't ease the anger of people like Vietnam veteran Richard A. Pittman, who was awarded the Medal of Honor in 1968.

He had left his platoon to help Marines under fire, exhausting several machine guns before hurling his final weapon at the enemy: a grenade. His actions halted the Vietnamese advancement and bought time that saved many of his wounded companions.

"I'm supportive of the Constitution, but in this case I just think they're wrong," said Pittman, 68, who now lives in California. "I wonder what the Supreme Court would think if part of my resume said I was a member of the Supreme Court or I answered my phone 'Justice Pittman.'"

iPhone 4S hates my car

I have a Pioneer FH-P8000BT in my car, which worked just fine with my old cheap feature phones and my old iPod touch, but the bluetooth function is unreliable with my iPhone. I can get it to connect and transfer the phone book just fine, I can start a call, answer a call, and siri sometimes understands me. The issue is sustaining a call.

The conversation starts to break up, as if I am loosing a signal, but when I change over to using the phone without bluetooth, it's just fine. This happens with and without the USB connection to the stereo.

I exchanged the phone and have the same problem. I can't figure out why I can get cheap phones to work just fine, but my iPhone goes nuts when using bluetooth in the car.

I tried using an old plantronics earpiece with the phone for comparison. Surprise, that works just fine, and siri understands me even better. I'm stumped and don't buy that it's the stereo because, as I have said, it worked perfectly with crap phones.

Any ideas?
